MAYI Yoga Academy Membership, Classes, Courses and Workshop Terms & Conditions

These Terms & Conditions (“Terms”) govern the enrolment, participation and membership in all classes, courses, workshops, instructor training programmes, events and other services offered by MAYI Yoga Academy Sdn. Bhd. (“MAYI Yoga Academy”, “Academy”, “we”, “our”, or “us”). By registering, enrolling, purchasing a membership, or participating in any programme offered by MAYI Yoga Academy, you acknowledge that you have read, understood and agreed to be bound by these Terms.

  1. Eligibility

1.1 Applicants must be at least eighteen (18) years of age at the time of registration.

1.2 An exception applies to participants enrolling in Super Yoga Kids classes and/or programmes. Participants under the age of eighteen (18) may only enrol through their parent or legal guardian, who must complete the registration process, provide all required declarations and consents, and accept these Terms on behalf of the participant.

1.3 MAYI Yoga Academy reserves the right to request proof of age, identity, passport, or legal guardianship at any time. Failure to provide satisfactory documentation may result in refusal of enrolment or participation.

1.4 Parents or legal guardians enrolling a minor warrant that all information provided is true, complete and accurate and accept responsibility for the participant’s compliance with these Terms.

  1. Membership and Registration

2.1 Membership, enrolment or registration is confirmed only upon receipt of full payment of all applicable fees.

2.2 Membership cards, attendance cards, instructor cards or any identification issued by MAYI Yoga Academy remain the property of the Academy at all times.

2.3 Members and students must present their membership or attendance card whenever requested by authorised personnel.

2.4 Members and students who fail to present a valid membership or attendance card may be charged the prevailing class fee.

2.5 Loss of a membership or attendance card must be reported immediately to the Academy.

2.6 A replacement membership or attendance card is subject to a replacement fee of RM50 or such other amount as determined by the Academy from time to time.

  1. Fees and Payment

3.1 All membership fees, course fees, workshop fees and any other applicable charges must be paid in full before the commencement of the relevant programme unless otherwise agreed in writing by MAYI Yoga Academy.

3.2 Failure to make full payment may result in cancellation of registration without reservation of a place.

3.3 All fees are payable in Malaysian Ringgit (RM), unless otherwise specified.

  1. Health Declaration

4.1 Participants are responsible for ensuring they are medically fit to participate in yoga and related activities.

4.2 All applicants must truthfully declare any health condition, injury, illness, pregnancy, physical limitation or any other circumstance which may affect their ability to participate safely in any Membership, Class, Course or Workshop.

4.3 All health declarations provided in the registration form must be complete and accurate.

4.4 MAYI Yoga Academy reserves the right to refuse or restrict participation where it reasonably considers participation may pose a risk to the participant or others.

4.5 Participants are encouraged to seek advice from a qualified medical practitioner before participating if they have any health concerns.

  1. Assumption of Risk

5.1 Participation in yoga and wellness activities involves physical movement and carries inherent risks.

5.2 Participants voluntarily assume all risks arising from participation and agree to practise within their own physical capabilities.

5.3 MAYI Yoga Academy, its instructors, employees and representatives shall not be liable for any injury, illness, accident or loss arising from participation except where liability cannot be excluded under applicable law.

  1. Cancellation, Cooling-Off Period and Refunds

6.1 Cooling-Off Period

New members are entitled to a ten (10) working day cooling-off period commencing from the date full payment is received.

If a participant decides not to proceed during this period, written notice must be submitted by email or letter within the cooling-off period.

Any approved refund shall be subject to deductions including, where applicable:

  • management fees;
  • cancellation fees;
  • course materials supplied;
  • classes or coaching sessions already attended; and
  • any other reasonable administrative costs incurred.

6.2 Cancellation Before Commencement

Cancellation requests for Memberships, Classes, Courses or Workshops must be submitted at least three (3) days before the scheduled commencement date.

Failure to attend without prior cancellation (“no-show”) shall be deemed attendance, and the relevant class or session shall be deducted from the participant’s entitlement.

6.3 Cancellation After Commencement

Once any Membership, Class, Course, Workshop or coaching session has commenced, no refund shall be provided except where MAYI Yoga Academy determines otherwise at its sole discretion.

Attendance at any coaching session forming part of a course shall constitute attendance for that portion of the course.

6.4 Early Termination

Participants wishing to terminate their Membership or enrolment must submit written notice to MAYI Yoga Academy.

The Academy is under no obligation to refund any fees already paid but may, at its sole and absolute discretion, consider exceptional circumstances on a case-by-case basis.

6.5 Refund Policy

No refund shall be granted after the expiry of the cooling-off period unless required by applicable law or expressly approved by MAYI Yoga Academy.

  1. Transfer and Suspension

7.1 Requests to transfer Memberships, Classes, Courses or Workshops are subject to availability, administrative requirements and any applicable fees.

7.2 Approval of any transfer request is entirely at the discretion of MAYI Yoga Academy.

7.3 Suspension of Memberships, Classes, Courses or Workshops may be granted for valid reasons upon written request.

7.4 Approval of any suspension request is entirely at the sole discretion of MAYI Yoga Academy.

  1. Rules and Regulations

To ensure a safe, respectful and enjoyable environment for all participants, members agree to comply with the following rules.

Attendance

  • Membership or attendance cards must be presented upon request.
  • Members must comply with all attendance procedures established by the Academy.

Conduct

Members shall:

  • behave respectfully towards instructors, staff and fellow participants;
  • follow all instructions given by authorised instructors;
  • wear appropriate attire suitable for yoga practice;
  • refrain from disruptive, abusive or offensive behaviour;
  • maintain appropriate personal hygiene.

Prohibited Conduct

The following are strictly prohibited:

  • unauthorised entry into the premises;
  • sharing membership cards or passes;
  • permitting unauthorised persons to enter;
  • entry through emergency exits except in genuine emergencies;
  • use of expired or invalid membership cards;
  • theft or attempted theft;
  • consumption or possession of alcohol on the premises;
  • attending classes while intoxicated;
  • digital recording, photography or videography during classes without prior written permission from MAYI Yoga Academy.

Any such conduct may result in immediate removal from the premises, suspension or termination of membership without refund.

  1. Personal Property

Members are solely responsible for their personal belongings.

MAYI Yoga Academy accepts no responsibility or liability for loss, theft or damage to personal property brought onto its premises.

The Academy shall not be responsible for lost, stolen or damaged membership or attendance cards.

  1. Health and Safety

Participants agree to practise responsibly and immediately inform instructors if they experience pain, discomfort, dizziness or any medical issue during a class.

The Academy reserves the right to refuse participation where safety concerns arise.

  1. Right to Refuse Entry or Terminate Membership

MAYI Yoga Academy reserves the right, at its sole discretion, to:

  • refuse admission to any person;
  • suspend or terminate any Membership, Class, Course or Workshop;
  • remove any participant from the premises;
  • refuse future enrolment.

Grounds may include but are not limited to:

  • breach of these Terms;
  • misconduct;
  • unsafe behaviour;
  • failure to comply with instructors’ directions;
  • non-payment of fees;
  • providing false or misleading information.

Termination under this clause may occur without refund.

  1. Facilities and Operations

MAYI Yoga Academy may temporarily close facilities or alter class schedules to carry out maintenance, repairs, improvements or operational changes.

Reasonable efforts will be made to minimise inconvenience to members.

  1. Complaints

Any complaint that cannot be resolved immediately should be submitted in writing to the General Manager.

The Academy will investigate complaints within a reasonable time and communicate its decision to the complainant.

  1. Privacy

By registering with MAYI Yoga Academy, participants consent to the collection, use, storage and disclosure of their personal information in accordance with the MAYI Yoga Academy Privacy Policy.

  1. Amendments

MAYI Yoga Academy reserves the right to amend these Terms at any time.

Updated Terms will be published on the Academy’s website and shall take effect upon publication unless otherwise stated.

Continued use of the Academy’s services after the revised Terms become effective constitutes acceptance of the amended Terms.

  1. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Malaysia.

Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.
